URGENT. …THE COUNTY WILL BEGIN REMOVING THOSE FUNDS THIS MONTH FROM FIRE ACCOUNTS….
In 2010, the voters of LeFlore County approved a tax resolution allocating ¼ cent to support all fire departments within the county.
In July 2023, the county commissioners significantly altered this resolution. They expanded its scope to include the LeFlore County 911 Trust Authority, allocating them 5.68% of each fire department's funds.

It is essential to recognize that the alternative appropriation of funds does not align with the voters' original intent. The people of LeFlore County should have been presented with this alternate resolution.
In recent years, fire departments have been requested to contribute $60.00 per month for dispatch services. A draft document specifying the services the 911 Trust would provide was never officially approved or distributed, leading most departments to opt out of payment.
According to Oklahoma state law (County Sales Tax - Exemptions - Purpose - Duration - County Sales Tax Revolving Fund (oscn.net)), specifically Section E: the proceeds from any sales tax levied by a county should be deposited into the general revenue or sales tax revolving fund. These funds must be used exclusively for the purpose for which the sales tax was designated.
According to the Oklahoma Constitution: SECTION X-19 Specification of purpose of tax - Devotion to another purpose. Every act enacted by the Legislature, and every ordinance and resolution passed by any county, city, town, or municipal board or local legislative body, levying a tax shall specify distinctly the purpose for which said tax is levied, and no tax levied and collected for one purpose shall ever be devoted to another purpose.( https://oksenate.gov/sites/default/files/2022-05/oc10.pdf)
Attorney General Opinion on modification of sales tax: Paragraph 16 : 1. Neither a board of county commissioners nor the governing body of a city, town or municipality is empowered to modify the purpose for which a sales tax was approved. Rather, any modification in the purpose of a tax already imposed may be authorized only by vote of the people residing within the taxing jurisdiction. Okla. Const. art.
