$8000 fine for attempted murder? There have been cases similar to this where people have died, the licence should have been cancelled and jail time applied!

The BPC has fined licensed plumber Kunjumon Mathai more than $8000 for installing an instantaneous gas hot water unit in the bathroom of a Cranbourne property.

It is an offence to install these units (unless room-sealed) in bathrooms, toilets, bedrooms or other sleeping areas. This is to reduce risk of dangerous exposure to carbon monoxide.

Along with the fine, Mathai must complete a training course in regulatory requirements within 12 months or face suspension in the class of gasfitting.

The BPC acts within its legislative powers to protect consumers and improve confidence in the building industry.

The Building and Plumbing Commission (BPC) is warning homeowners of the dangers of hiring unregistered builders after a South Melbourne couple was forced to sell their home over an illegal renovation.

A magistrate convicted Andrew Lennox and his company Atomic 6 Pty Ltd and fined them $70,000 for 8 offences under the Building Act – including carrying out building work while unregistered and working without a permit or the required insurance.

The couple paid $100,000 to Lennox but the job stalled after demolition works, leaving them out of pocket with an unsealed roof leading to water damage.

When a builder is unregistered, the BPC must rely on the courts to hold them to account, which can be a lengthy and costly process.

Consumers should always use a registered builder and a licensed or registered plumber, and can check these credentials at our website: bpc.vic.gov.au/check.

Lennox’s company Atomic 6 is now in liquidation.

Really loving the Name & Shame approach Victoria have taken😮!

The Building and Plumbing Commission (BPC) has fined ex-plumber Ricky Barlow $14,271 and disqualified him for 3 years for misleading clients and working without a licence.

Barlow carried out non-compliant and defective roofing (stormwater) and gasfitting work at a home in Clayton without ever having been licensed in those classes.

He was licensed and registered in other classes, but his accreditation lapsed before the job was finished. He then gave the client a fake compliance certificate.

Barlow continued working as a plumber for months at multiple sites, duping clients into thinking he was licensed by showing them proof of insurance.

Only a licensed plumber can issue a compliance certificate, and they must be licensed in each appropriate class for the work undertaken. Registered plumbers must be supervised by a licensed plumber.

Another one bites the dust! Be weary when hiring a tradie, always check their license and as important, their license history

The BPC has disqualified Zakariya Houssein from the industry for the statutory maximum three years.

Houssein, a licensed plumber at the time, was found guilty of negligence relating to non-compliant plumbing work at multiple sites across Melbourne over several years.

He also was found guilty of lodging compliance certificates despite the work being non-compliant and failing to comply with rectification notices.

Houssein also permitted unlicensed and unregistered people to carry out plumbing work in the class of roofing (stormwater) at a site in Deanside.

Houssein has been fined $13,273 plus $994 in inquiry costs.

The BPC acts within its legislative powers to protect consumers and improve confidence in the building and plumbing industries.

A Western Sydney man has been sentenced to three years prison with an 18-month non-parole period after defrauding homeowners out of nearly $200,000 while posing as a licensed tradie.

From 2021 to 2023, Gareth James Bryant operated the companies: Brycon Group Constructions, Pure Lifestyle Renovations, Outbuild Constructions and Forever Green Landscapes and Constructions and would respond to advertisements looking for residential building work, take excessive deposits for work, did not complete or start the work, and then failed to provide refunds or compensation for defective work.

The Penrith Local Court found Mr Bryant had defrauded 26 victims out of a total of around $200,000. Mr Bryant pleaded guilty at the Penrith Local Court to four counts of Causing Financial Disadvantage by Deception (fraud) on the basis he contracted for residential building work while unlicensed and used falsified documents to obtain financial advantage.

The conviction was secured thanks to a joint investigation conducted by Building Commission NSW, NSW Fair Trading and NSW Police Force
