🛑IMPORTANT REMINDER FOR BUSINESSES🛑

A mandate is essentially just a request, and has no official standing within law. A mandate only truly comes into force when the person/business who is requested takes part/agrees. So yes, the government response here is correct. It’s extremely dirty, but it’s correct.

The government is doing indirectly what it can’t do directly, and is passing the legal buck onto businesses. Businesses can of course be sued under the law, if they enforce any mandates which are contrary to law (as in, actual legislation, written in black and white).

Everyone must be so, so careful. Mandates are essentially null and void if they are challenged in court, as they are only a request/direction/rule - they are not law. Also, if you receive a fine for not following a mandate, it can be challenged in court and it’ll be thrown out as you technically haven’t broken a law.

COVID-19 QLD UPDATE
LOCKDOWN INFORMATION
FOR THE LANDSCAPE INDUSTRY
Dear Industry Colleague
Lockdown is in force from 6 pm today Tuesday 29th June until 6 pm Friday 2 July.

A number of Qld local government areas will go into lockdown including Townsville, Palm Island, Brisbane, Ipswich, Logan City, Moreton Bay, Redlands, Sunshine Coast, Noosa, Somerset, Lockyer Valley, Scenic Rim and Gold Coast

Residents in these areas can only leave their residence (which includes temporary accommodation such as a holiday rental) for limited permitted purposes such as:
obtaining essential goods or services, including healthcare (including vaccinations)
exercise
attending essential work or childcare
assisting vulnerable persons
Landscape and Garden Maintenance Industries

The Landscape industry in Queensland does not appear on the list of NON - ESSENTIAL Businesses. This means that the broader Landscape Industry CAN continue to operate subject to adhering to the Coronavirus WHS precautions as stipulated by the Government.

Social Distancing
Hygiene (sanitiser, hand washing etc)
Note: Admin staff may need to work from home if they can do so or wear masks and social distance if attending the office.

COVID-19 SAFETY PRACTICES FOR LANDSCAPERS
A reminder to continue with best practice to minimise the risk of exposure to COVID-19.
Members should ensure their COVID plan is up to date. Now is the time to remind ourselves and our teams to keep up to date with safety measures both on-site and at home. Including and not limited to:

Wearing masks at all times when you leave home
Avoiding touching others such as shaking hands, kissing or hugging
Increased hygiene measures with hand washing, sanitiser and cleaning protocols
Masks should be worn in work vehicles where there are 2 or more people
Social distancing and limiting numbers of people on tasks/on site to only those necessary
Masks should be worn on site, if unable to socially distance
Limiting close contact with Homeowners - opting for conversations that can be had over the phone, as well as sending only those who are required on job-sites

If you or your team are unwell, stay at home and remember to get tested

EXTENSION OF TIME (EOT) FORM 1
A reminder for members, given the recent weather delays and COVID-19 Lock Down, remember to log into the LQ website and head to the Contracts and Member Resources tab should you require an Extension of Time Form 1.

If you or your team are unwell, you must stay at home and remember to get tested.

You can be issued a $200 on the spot fine if you refuse to wear a face mask without a lawful reason or excuse.

QUEENSLAND WIDE
Those who have recently visited or leaving Townsville, Palm Island, Brisbane, Ipswich, Logan City, Moreton Bay, Redlands, Sunshine Coast, Noosa, Somerset, Lockyer Valley, Scenic Rim and Gold Coast in the past two weeks, must follow the same lockdown rules when you return home, regardless of where your destination is.

If you live outside South East Queensland, Townsville or Palm Island, you can transit through those areas without stopping.
