Do I Need Planning?
An addition or extension to your house* is generally considered to be permitted developments. So you won’t need to go through the additional hassle of getting planning permission as long as:
• Your extension is no more than half the area of land around the original house (curtilage). The “original house” is seen as it was in 1948; after this date how it was newly built
• Your extension is not forward of the principal elevation or side elevation onto a highway
• Your extension is not higher than the highest part of the roof
• In the case of single storey extensions, it must not extend beyond the rear wall of the original house by more than three metres if an attached house or by four metres if a detached house
• The maximum height of your single-storey rear extension is not higher than four metres
• Extensions of more than one storey do not extend beyond the rear wall of the original house by more than three metres
• Side extensions are single storey with maximum height of four metres and width no more than half that of the original house
• Two-storey extensions are no closer than seven metres to rear boundary
• The materials are similar in appearance to the existing house
• Your extension does not include verandas, balconies or raised platforms
• Any upper-floor, side-facing windows are obscure-glazed; any opening is 1.7m above the floor
Conservatories are categorised as the same as any other extension, as set out above.
*Different rules apply to flats and maisonettes.
There are also different planning restrictions for designated areas such as Conservation areas and if your property is listed. So check with your Local Planning Authority

Party Wall

As anyone who is considering building an extension will have realised, neighbours have an important role to play in many aspects of the planning process.
They will experience some of the pain of the work without enjoying the benefits, so it is crucial to keep them informed and on side. It is also a point of law that you must give them notice before starting work close to the boundary with their property. Getting this wrong could delay your build and make your project more costly. Getting it right will provide the foundations for a smooth build.
If you are carrying out works governed by the Party Wall Act, you need to serve a party wall notice on your neighbours. This must be done at least two months before the notifiable works begin, and at least one month before the notifiable excavation works begin. Notifiable work is either building work which affects a party wall or boundary line, or excavations within three or six metres of a neighbouring property (depending on the depth of the foundations you are making). This will include most extensions and basement and loft conversions.
You need to serve notice on all the owners of every neighbouring property affected by the works, both freeholders and leaseholders. You don't need planning permission for your plans to serve notice, and once you've done so you can take up to a year to start work.
If your plans change slightly after you've served notice – for example, if you decide to increase the depth of your extension – you should be able to submit revised drawings to your neighbour without having to serve a new notice.
There is "realistic potential" for damage when undertaking party wall works. So it's not surprising that failure to comply with the act could result in your neighbour taking you to court and obtaining – at your expense – an injunction to prevent you from continuing with the work. And that's not the worst of it. "If you haven't obeyed the act and you cause major damage to your neighbour's property, it could result in a Judge ruling for you to pay compensation to the neighbour. Ensure your builder has the required insurance!!!

Do I need Planning? Not all extensions require planning permission, the majority of homes have an automatic right to extend or build a hobby room etc without consent. It is referred to as you Permitted Development Rights. We offer a free service of advising you on whether or not what you are planning may be built under your permitted development rights. If this is the case, you only need Building regulations, and we will assist with ways you may be able to obtain this so expediting the start of your building project.
