A Third Surveyor is selected when two surveyors are appointed under the Act. Either of the surveyors or either of the parties may call upon the Third Surveyor to determine a disputed matter. Referrals are not normally required and should be considered carefully as costs can be assigned to either or both parties by the Third Surveyor in his/her Award.

Can I give my neighbour an extension of time to respond to a Notice? Yes you can, an adjoining owner can consent to a Notice at any time. It is worth giving an extension of time if you think you might receive a consent and thereby avoid the cost of an Award.
