Pat Testing Legal Requirements

Pat Testing has lots of myths floating about and many people get confused with what is required from them to ensure they comply with regulations and to keep the ris

k to staff minimal. It can also be confusing as there are several different regulations to look at. On this page you will find the requirements that cover the legislation of specific relevance to electrical maintenance. The Health & Safety at Work Act 1974, the Management of Health & Safety at Work Regulations 1999, the Electricity at Work Regulations 1989, the Workplace (Health, Safety and Welfare) Regulations 1992 and the Provision and Use of Work Equipment Regulations 1998. The Health & Safety at Work Act 1974 puts the duty of care upon both the employer and the employee to ensure the safety of all persons using the work premises. This includes the self employed. The Management of Health & Safety at Work Regulations 1999 states:

"Every employer shall make suitable and sufficient assessment of:
•(a) the risks to the health and safety of his employees to which they are exposed whilst at work, and
•(b) the risks to ensure the health and safety of persons not in his employment arising out of or in connection with the conduct by him or his undertaking." The Provision and Use of Work Equipment Regulations 1998 states:

"Every employer shall ensure that work equipment is maintained in an efficient state, in efficient working order and in good repair." The PUWER 1998 covers most risks that can result from using work equipment. With respect to risks from electricity, compliance with the Electricity at Work Regulations 1989 is likely to achieve compliance with the PUWER 1998. PUWER 1998 only applies to work equipment used by workers at work. This includes all work equipment (fixed, transportable or portable) connected to a source of electrical energy. PUWER does not apply to fixed installations in a building. The electrical safety of these installations is dealt with only by the Electricity at Work Regulations. The Electricity at Work Regulations 1989 states:

"All systems shall at all times be of such construction as to prevent, so far as reasonably practicable, such danger." "As may be necessary to prevent danger, all systems shall be maintained so as to prevent, so far as reasonably practicable, such danger." "'System' means an electrical system in which all the electrical equipment is, or may be, electrically connected to a common source of electrical energy and includes such source and such equipment"

"'Electrical Equipment' includes anything used, intended to be used or installed for use, to generate, provide, transmit, transform, rectify, convert, conduct, distribute, control, store, measure or use electrical energy." Scope of the legislation

It is clear that the combination of the HSW Act 1974, the PUWER 1998 and the EAW Regulations 1989 apply to all electrical equipment used in, or associated with, places of work. The scope extends from distribution systems down to the smallest piece of electrical equipment in the work place and it is very clear clear that there is a requirement to inspect and test all types of electrical equipment in all work situations to be compliant.

PRESS RELEASE: Tumble Dryer Fire in Milford Haven - 09-04-25
--
At 5.52pm on Wednesday, April 9th, Mid and West Wales Fire and Rescue Service (MAWWFRS) crews from Milford Haven Fire Station responded to an incident at a domestical property in Steynton, Milford Haven.

Crews responded to a tumble dryer fire that was caused by the use of a block adapter.

Luckily, on this occasion the occupiers were in their home at the time of the incident, otherwise it could have been a story with a very different ending.

Crews left the scene at 6.15pm.

Following this fire, MAWWFRS is issuing a reminder on electrical safety, tumble dryer and white goods safety:

Most households use extension leads or adaptors to increase the number of appliances that can be plugged into a wall socket. It is important that these devices are fused to minimise the risk of overheating and potential fire hazards.

While extension leads allow more appliances to be connected, this does not always mean it is safe to do so. Different electrical appliances consume varying amounts of power. To reduce the risk of overheating and fire, never plug in appliances that together exceed 13 amps or 3000 watts of energy.

NEVER leave appliances unattended - don’t turn your tumble dryer on before you leave the house or go to bed. Tumble dryers contain powerful motors with fast-moving parts that get very hot.

Don’t overload your tumble dryer or put in items that have been used to soak up flammable liquids including cooking oil.

Don’t ignore warning signs - if you can smell burning or have clothes that feel hotter at the end of the cycle, have your appliance checked by a professional.

⚠️ Are clover leaf-shaped plugs in your home? They may look harmless, but if they don’t contain a fuse, they are a serious fire hazard. 🔥

Clover leaf plugs are small in size, not meeting the legal requirements of a plug to be sold in the UK and are frequently found to be missing a fuse - a potential fire risk.
