✅ 10 Terms & Conditions Before Buying/Leasing/Selling Land

1. Proof of Ownership

Seller must provide an original title deed or allotment letter.

Confirm the land is registered under their name at the Ministry of Lands/Ardhi House.

2. Search at Lands Registry

Buyer must conduct an official land search to confirm ownership, any charges, caveats, or disputes.

3. Land Use & Zoning Restrictions

Clarify if the land is for residential, commercial, agricultural, or industrial use.

Buyer must comply with county zoning regulations.

4. Survey & Boundaries

Land must be properly surveyed with beacons intact.

A licensed surveyor must verify size and boundaries (e.g., 50x100, 100x100).

5. No Encumbrances

Land should be free from loans, mortgages, or legal disputes.

Seller guarantees the property has no third-party claims.

6. Payment Terms

Mode of payment (cash, installments, or bank transfer) must be agreed in writing.

Buyer receives an official receipt for every payment made.

7. Transfer of Ownership

Seller must facilitate transfer of title deed to buyer within agreed period (usually 90 days).

Both parties to sign a sale agreement before a lawyer/advocate.

8. Stamp Duty & Legal Fees

Buyer to cater for stamp duty, transfer fees, and registration charges unless agreed otherwise.

Seller caters for clearance of any pending land rates or taxes.

9. Vacant Possession

Seller must hand over land free from squatters, tenants, or any other occupation.

Lease agreements (if leasing) must clearly define start date, duration, and termination clause.

10. Dispute Resolution

Any dispute arising shall be settled through arbitration, mediation, or Kenyan courts under the Land Act.
