In the application to separate the crimknal trial, the Court is having the discretion which must be exercised judiciously.

It is established that the multiplication of Proceedings as far as possible be avoided, it is generally accepted that in the interest of the administration of justice, persons charged together with same counts be tried together, as such it is prudent for the prosecution to prove its case especially where accused persons acted in common purpose to commit crimes.

Separation of trial can only be considered if the applicant (accused) likely to suffer prejudice, but not at the expense of fellow accused persons to be prejudiced.

So, the separation in the fishrot matter is minimal.
