What you need to know about updating a Flats Plan 👇
✅ CONSENT
Under current legislation, any lease longer than 35 years is treated as a subdivision. That means updating a Flats Plan isn’t simple — it requires subdivision consent from Council.
✅ AGREEMENT
Even if only one unit is affected, all landowners on the cross-lease titles are involved. Everyone must become signatories and agree before the process can even begin.
✅ ALTERATIONS
Updating the Flats Plan doesn’t change the ownership structure — the property remains a cross lease, with the same neighbour controls and restrictions. Any future additions or alterations to building outlines? You’ll need to go through this process all over again to rectify it.
