🏗️ As a licensed architect in the Philippines, accepting a project without a land title is legally possible—but it comes with critical limitations and risks I should be aware of:
⚖️ Legal and Ethical Considerations
• No Building Permit Without Title: Under the National Building Code (PD 1096), a valid land title or proof of legal possession is required to secure a building permit. Without it, construction cannot legally proceed.
• Architect’s Liability: As the Architect-of-Record, I am professionally and civilly liable for the plans I sign and seal. If the project proceeds without proper land documentation, I may be exposed to legal disputes or sanctions.
• Service Agreement Protection: RA 9266 (Architecture Act of 2004) requires a notarized Service Agreement. I can still enter into one for pre-design services (e.g. feasibility studies, site analysis, conceptual design), and must clearly state that full architectural services are contingent on securing legal land documents.

RA 9266 - Article IV Section 25 & 31

PRACTICE OF ARCHITECTURE

Registration of Architects Required:

No person shall practice architecture in this country, or engage in preparing architectural plans, specification or preliminary data for the er****on or alteration of any building located within the boundaries of this country or use the title "Architect," or display or use any title, sign, card, advertisement, or other device to indicate such person practices or offers to practice architecture, or is an architect, unless such person shall have received from the Board a Certificate of Registration and be issued a Professional Identification Card in the manner hereinafter provided and shall thereafter comply with the provisions of this Act.

Liability of Representatives of Non-Registered Persons:

It shall be unlawful for any person or firm or corporation to seek to avoid the provisions of this Act by having a representative or employee seek architectural work in their behalf, unless and until, such persons have duly qualified and are duly registered/licensed, otherwise, both those represented and representative, the employer and the employee shall be deemed guilty of violation of this Act. Solicitation of architectural work shall be construed as offering to practice architecture and shall be unlawful for any non-registered and unlicensed persons to do so.
