Tornadoes can cause devastating damage to properties in a matter of minutes. These powerful rotating columns of air can tear through buildings, uproot trees, and scatter debris over a wide area. The severity of the damage depends on the tornado’s strength, duration, and the structural integrity of the affected properties.

The report cards are in, revealing that some Florida insurance companies aren't quite making the grade.

There is a chilling effect about to happen on Florida’s Homeowners and it’s not the December weather. The Florida Senate and House leadership have sold out to the insurance industry, again at the expense of Florida Policyholders.

The Florida Senate and House have proposed legislation that will effectively prevent Policyholders from being able to hold insurance companies accountable. If passed, these new laws will allow insurance companies to take even more advantage of Policyholders and will only foster even more dishonest claims handling by insurance companies.

Although the bill is riddled with friendly language for the insurance companies and only harming language for Policyholders, here is the bottom line:

1. Policyholders are now responsible for all of their attorney’s fees —even if the insurance company wrongfully denies, underpays, or delays their claim. This will leave Policyholders having to represent themselves or simply force policyholders to not seek any additional insurance benefits if an insurance company underpays a claim because it is uneconomical to hire an attorney and file a lawsuit.

2. Policyholders will be left with no viable action against an insurance company for an insurance companies violation of the claims handling statutes absent a trial court judgment. In other words, bad faith actions are effectively dead in Florida; except in rare circumstances. This means here is essentially no avenue for a Policyholders to enforce penalties for late payments and/or intentional claim delay tactics.

3. Policyholders will have no more right to assign policy benefits to companies providing emergency mitigation services like water extraction and mold remediation. This change will require Insureds to make immediate out of pocket payments for potentially thousands of dollars while waiting on the insurance company to make its decision.

4. Insurance companies can further prevent Policyholders access to courts by placing strict mandatory, Insurance Company friendly, arbitration provisions.

5. Many Policyholders will be forced to pay for flood insurance, even if not in a flood zone.

6. Insurance companies will now be allowed to do an adjustment of an insured structure without ever having to physically inspect the insured structure. Insurance companies can now adjust a claim by using only photographs and digital means to estimate.

7. The proposed Bill again limits the time Policyholders must file a claim. This would be the second time in 2022 The Florida Senate and House would be lessening the time for all Policyholders to discover hidden damages and report a potential claim

8. Although the proposed Bill removes the ability to recover attorney fees against an insurance company the language now allows an insurance company to collect fees from the policy holders!

The bottom line is that the Florida political leaders are proposing new provisions that will help the Insurance Industry at the direct harm and expense of all Policyholders. These new proposed laws and the elected officials voting for them are simply selling out to the insurance companies. There is no way to sugarcoat it.

Florida’s special session begins today. Call or email your elected officials now and let them know that while consumers are suffering and trying to rebuild from the recent hurricanes, they need help and real reform, not gifts to the insurance industry.
