Homicide Arrest
Today, Northampton County District Attorney Terence Houck announces charges against Jose Luis Leon for the homicide of 35-year-old Elson Aviles of Bethlehem.
Leon is facing charges of criminal homicide, possessing instruments of crime, simple possession, and two counts of aggravated assault.
Just before 1 a.m. Friday, October 8, Bethlehem officers observed two individuals in the middle of the street in the 900 block of East 4th Street in Bethlehem while on patrol.
Officers approached both males, and observed one male covered in blood collapsed on the street. Officers made contact with the male, later identified as 35-year-old Elson Aviles of Bethlehem, noting he was bleeding from the neck and chest area.
While rendering end, officers observed the second male, identified as 30-year-old Jose Luis Leon, of Bethlehem, standing nearby holding a large kitchen knife. Officers ordered Leon to drop the knife. He complied and was detained. When officers asked the victim who did this, Aviles responded with, “Jose” while pointing toward Leon.
Aviles was transported to St. Luke’s Hospital – Fountain Hill, where he underwent emergency surgery. He subsequently died from his injuries.
After Leon was taken into custody, officers performed a search on his person and found one plastic bag containing a rock-like white powdery substance, and one clear baggie containing numerous white round pills. The items were field tested by Bethlehem officers, and tested positive for fentanyl with a combined weight of 23.6 grams.
Leon was then transported to Bethlehem Police Department headquarters, where he was placed in the cell block area. Once inside, Leon reached into his waistband while blading his body away from officers. Officers attempted to stop Leon from reaching into his waistband, when Leon turned toward officers and began aggressively throwing punches at the officers. One officer was punched in the face and the other twice in the head. The officers were on official police duty in full uniform at the time of the assault.
“A quick response by Bethlehem’s Patrol Unit, coupled with an immediate and intensive investigation by the Criminal Investigations Unit culminated in the swift arrest of the defendant in this case,” District Attorney Houck said. Leon was arraigned today in front of Judge Zumas and bail was denied.
As in every criminal case, the defendant is presumed innocent until proven guilty.
