The State Legislature returned to Albany on Monday and held four days of session. In that short period of time they attempted to push through another expansion of prevailing wage as well as the long dreaded “Condo Bill.”
Due to a strong lobbying effort by NYSBA and our members, neither bill passed both houses.
The prevailing wage legislation would have included the delivery of aggregate supply construction to be covered under prevailing wage. Thus the Legislature was attempting to change prevailing wage even before the new law took effect in 2022.
While the bill passed the Senate on Thursday, the sponsor when speaking on the bill on the Senate floor clarified that private projects would not be impacted by this legislation. The Senator made that statement at the request of NYSBA.
Since the bill did not pass the Assembly, we will look to have the bill further amended so that intent is specifically spelled out.
As to the Condo Bill (A.5221/S.7057), the Assembly passed that bill on Thursday, but NYSBA had received assurances from several State Senators that it was not moving in their house. That legislation would permit municipalities to opt out of the current assessment methodology applied to condominium and cooperative units located outside the City of New York and Nassau County. Thus taxing condos at the same rate as single-family homes.
We anticipate the Legislature will not return to Albany for another two to three weeks. At which time, the process will begin again... NYSBA’s Government Affairs Committee will be meeting through conference call on July 27 at 1pm to discuss the events that took place last week, as well as planning for the next legislative session in August.
