Riparian Boundaries for Arkansas

Presented by: Dick Elgin, PS, PhD
Description:Rivers make convenient boundaries; however, as natural, visible and inviting as they are for governments, treaties and owners, they have one huge, troublesome characteristic: they move. And, defining exactly where a boundary along or in a river is located can be very difficult. All riparian boundaries are dependent on the river being navigable or nonnavigable. What are the rules and legal principles applicable to riparian and littoral boundaries? Who determines navigability? What happens to the riparian boundary when the river moves? Moves slowly? Moves quickly? What effect does re-emergence have on title? Who owns the bed of once navigable riverbed, now dry following an avulsion? How can one write a boundary description of a tract adjoining a river if it is unknown if the river is navigable or nonnavigable? All these are interesting questions (and there are others) to which the Arkansas Professional Surveyor should know the answers. In this Arkansas riparian boundary primer, these topics (and others) will be reviewed.

A top-secret, raised-relief model of Utah Beach helped the Allied leadership, including Eisenhower and Montgomery, plan for D-Day.
