Plans were drafted by the Carrier's Engineer and approved. Yet the Game continues.

All necessary code and compliance sheets are included. and yes, we had to inform the engineer what climate zone our city is in.

However, the Adjuster claims that the "AS WAS BUILT" item did not previously exist or expand the scope of repairs, stating, "We need to fail the inspection and prove it." 

The statement actually means is “we’re going to place financial risk on the insured and the contractor. The burden of proof is on the contractor.” 

As the contractor, we stand resolute on substance and principle. 

As the contractor of record, we would like to clarify that we are not failing the inspection. That their assertion is untenable.

The adjuster will continue to send emails little snips of policy. Our clients are always in the emails yet their little snips never give any information to the insured.

We continuously inform them that we are not public adjusters. We are not adjusters. We do not decipher or interpret policy. That we have provided them with all of the excessive documented request. Photos accurate material cost that need to be included in the claim file and offer the adjuster the opportunity to understand certain codes, the adjusters response is “that was lengthy narrative”.

The adjuster needs to govern himself accordingly.

The request now will be mailed to the adjusters and the carrier for his attendance at the first inspection. Failure to attend will result in a halt to work. This request is signed by TCC and our client.

It is not a contractor's job to enter into a circular misleading disagreement.

A contractors cannot deviate from stamped plans or the building inspector's direction.

We are professionals in our field, and it is important to respect our role in the construction process.

The role of an adjuster is to diligently inspect assess, once the claim is a cover loss, the adjuster’s job is still to continue to work diligently and honestly, and adjust accordingly to the policy also the adjuster’s job to explain the policy to the insured.

It is not the adjuster’s job it is not to dictate how we build.

This adjuster latest ditch attempt in his email to us stated that “if we need to understand code, we should call the engineer on record.”

With all due respect, it is not us that needs to call the engineer of record to understand code compliance.
