Your Structural Adequacy Study Is Complete. But Do You Still Have Concerns?

If your condominium association recently completed a Structural Adequacy Study but residents or board members are still noticing concerning conditions—new or growing cracks, concrete deterioration, corrosion, movement, sticking doors, water intrusion, or other changes—those concerns should not automatically be dismissed simply because a study was completed.

Has New Jersey’s structural inspection law created a false sense of security?

The law was created for the right reason: identify structural deterioration in condominium buildings before it becomes a tragedy.

But we are seeing a troubling pattern.

At more than a dozen condominium properties we’ve encountered, associations had already received structural evaluations that left them believing their buildings were in satisfactory condition. When we subsequently became involved, we found conditions that raised significant structural concerns.

At one approximately 40-unit condominium, there were signs of significant foundation settlement, cracked floors, doors that would no longer operate properly, and deteriorated, corroded and deflecting structural members.

The prior engineering report identified no structural repairs as necessary.

At another large North Jersey condominium, a recent structural evaluation had given the association confidence in the condition of its property. Our subsequent investigation identified significant deficiencies within the parking structure.

This raises a question New Jersey needs to start asking:

Who is checking the inspections?

A law can require an engineering report. It cannot guarantee the quality of the investigation behind it.

And an inadequate inspection may create something more dangerous than uncertainty: false confidence.
