Compliance 101: Understanding Florida Statute 768.0706
We often receive inquiries about how properties can comply with Florida Statute 768.0706 (HB837). This article provides an overview of the essential requirements for compliance.
Key Compliance Deadline
The Florida State required CPTED Assessment was due to be completed for each affected property by January 1, 2025.
The CPTED Assessment
CPTED stands for Crime Prevention Through Environmental Design, a strategy aimed at reducing crime through design techniques and management strategies. All affected properties are required to undergo a mandatory CPTED assessment, which must be conducted by a certified CPTED Practitioner or law enforcement agency approved by the Florida Attorney General's Office.
A crucial aspect of this assessment is that it must be executed by a Third Party. This requirement ensures that the assessment is impartial and objective. Each assessment is valid for three years, and currently, no other CPTED certification or training qualifies a professional to conduct these assessments.
Management Action Plan (MAP)
Upon receipt of the CPTED assessment results, property management/ownership is obligated to thoroughly review all findings and recommendations. This process includes creating a Management Action Plan (MAP) that addresses the identified security concerns. The MAP should:

Assign responsibilities
Establish a timeline for implementation

Initial Security Awareness Training
In conjunction with the CPTED assessment, all personnel associated with the property must complete mandatory crime deterrence and safety training. This training component covers the critical issues outlined in Subsection A of the statute and must be conducted by the same State-Certified CPTED Practitioner who performed the initial assessment.
Ongoing Training for New Hires
All new employees hired after January 1, 2025, will also need to complete the security awareness training within 60 days of their start date. Employers may use the same training materials from the initial training to ensure consistency and compliance.
Regular CPTED Reassessments
To maintain effective crime prevention strategies, a new CPTED assessment is required every three years from the initial assessment date. Property owners have the option to engage the original CPTED practitioner or select a different provider.
