This Memorial Day, we pause to honor the brave individuals who gave everything in service to our country.

APEX is proud to have contributed to the National WWII Memorial in Washington, D.C., a landmark dedicated to those who served in the Atlantic and Pacific theaters of war. Our role in supporting that tribute remains one of the most meaningful projects in our history.

Delaware business leaders, educators, contractors, and workforce advocates have made their opposition to SB 272 clear, but lawmakers are continuing to move the bill forward.
SB 272 would require Project Labor Agreements (PLAs) on all public school construction projects over $1 million. That means higher construction costs, fewer opportunities for local and merit shop contractors, and added barriers for Delaware workers and students entering the trades.

When the cost to build schools goes up, the impact falls on students, classrooms, and taxpayers.

Opposition to this bill is coming from across Delaware, including chambers of commerce, minority business organizations, vo-tech leaders, contractors, and workforce advocates. These voices deserve to be heard. Tell your elected officials: Vote NO on SB 272.

SB 272 has been introduced as a replacement, shifting focus to school construction and renovation projects over $1 million. But at its core, the issue hasn’t changed: a government-mandated PLA requirement that limits who can compete for public work.

SB 241 would require Project Labor Agreements (PLAs) on most state construction projects over $5M. This means contractors must follow union-negotiated labor terms to bid on public work. SB 241 replaces performance-based contracting, shifting how contractors qualify for public work. Delaware is a merit shop state, 9 out of 10 construction workers (approximately 90%) have chosen not to affiliate with a union.

👉 SB 241 is government overreach that picks winners and losers.
The government’s role in public construction should be to set safety, quality, and ethical standards. Not to dictate labor agreements.

👉 SB 241 will drive up costs for Delaware taxpayers.
It will limit competition, raise costs, and shut out a significant portion of Delaware’s workforce, especially small, non-union, merit-based contractors.
