State Farm told an Oklahoma court that the Attorney General has no business suing an insurer. Only the Insurance Commissioner can do that, they argued. Wrong office. Case should be thrown out.
Then the Attorney General filed Exhibit 2.
A letter. Oklahoma Insurance Department letterhead. January 29, 2026. Signed by Insurance Commissioner Glen Mulready himself:
"I request that you, as Oklahoma's chief legal officer, partner with my office to continue your investigation, intervention and prosecution…"
The exact official State Farm says holds exclusive power over insurers had already asked the Attorney General to prosecute State Farm. In writing. Seven months before the motion was filed.
And it gets tighter. Oklahoma's racketeering law lets NO private citizen sue — by statute, only the Attorney General and district attorneys can bring an ORICO case. The Insurance Commissioner can't. So as the State's response puts it: if the Attorney General can't bring these claims against an insurance company, no one in Oklahoma can.
There's more in the 22 pages. The Oklahoma Supreme Court told the AG in June to file this exact standalone lawsuit — he filed it the NEXT DAY. The State's theory of the case in one sentence: "concealed, extra-contractual standards to deny benefits State Farm was contractually obligated to pay while representing otherwise to policyholders." And a penalty provision that allows up to $10,000 per violation… in a state where State Farm's own court filing counted 117,019 wind and hail claims.
⚖️ September 28, 9:00 a.m. Judge Jeff Virgin. Cleveland County Courthouse, Norman. That same morning, 20 miles north in Oklahoma City, a different judge hears the fight over unsealing roughly 110,000 State Farm documents. One insurer. Two courtrooms. One morning.
State Farm denies wrongdoing and says it evaluates every claim individually. Nothing has been ruled on — that's exactly why you should read the filings yourself instead of taking anyone's word for it. We host all of them free: the full response, both exhibits, the hearing notice, every document in the case. No paywall, no login, every page searchable.
