A PROPOSAL FOR LOCAL FOOD FREEDOM IN UNION
A modern Local Food Sovereignty Ordinance for consideration by the voters of Union, Maine
I believe people should be able to buy food directly from the person who grew, raised, or made it, and that informed adults should be trusted to make those choices for themselves.
Maine has already created a legal framework allowing municipalities to govern direct producer-to-consumer food transactions. Union considered a local food ordinance in 2021, but the old draft was unnecessarily complicated and contained unfinished drafting language. I think the idea deserves another look in a cleaner, narrower, and more legally serious form.
This proposal is not about eliminating responsibility for unsafe conduct, fraud, or injury. It is about protecting voluntary, direct transactions between local producers and informed customers, while keeping the ordinance within the authority Maine law gives municipalities.
PROPOSED ORDINANCE
1. Title
This ordinance shall be known and may be cited as the Town of Union Local Food Sovereignty Ordinance.
2. Purpose
The purpose of this ordinance is to exercise the authority granted to municipalities under Maine law to protect direct producer-to-consumer food transactions; strengthen family farms and small-scale food production; preserve traditional foodways; improve local food security; and allow informed individuals to make their own choices concerning food obtained directly from local producers and processors.
3. Policy
It is the policy of the Town of Union that residents should be free, to the maximum extent permitted by Maine law, to produce, process, prepare, preserve, purchase, sell, barter, trade, and consume local food through direct producer-to-consumer transactions. The Town recognizes that direct relationships between producers and patrons promote transparency, personal responsibility, self-reliance, and a resilient local economy.
4. Definitions
Direct Producer-to-Consumer Transaction means a direct exchange of local food between its producer or processor and an informed patron by sale, purchase, barter, trade, donation, or other direct exchange, including transactions at a farm or roadside stand, farmers' market, community event, through direct delivery, community-supported agriculture, a buying club, herd-share arrangement, or another direct arrangement recognized by Maine law.
Local Food means food or a food product produced, processed, prepared, preserved, or otherwise handled by a producer or processor and exchanged directly with a patron.
Patron means an informed individual obtaining local food directly from its producer or processor for personal or household consumption.
Producer means a person who grows, raises, harvests, gathers, or produces plants, animals, or agricultural products for food or drink.
Processor means a person who processes, prepares, preserves, packages, or otherwise transforms food or agricultural products for food or drink.
5. Local Governance
Direct producer-to-consumer transactions within the Town that fall within municipal authority under the Maine Food Sovereignty Act shall be governed by this ordinance. To the maximum extent permitted by Maine law, the Town shall not impose a food-specific municipal license, permit, inspection, certification, or approval solely as a condition of participating in such a transaction. This section does not prevent enforcement of generally applicable municipal laws outside the regulation of food production or direct food transactions.
6. State Law
The Town intends this ordinance to exercise the municipal authority recognized by the Maine Food Sovereignty Act, including 7 M.R.S. Chapter 8-F. Transactions governed by this ordinance shall receive the exemptions from state food licensing, permitting, inspection, and other regulatory requirements provided by Maine law. Nothing in this ordinance creates an exemption broader than state or federal law permits.
7. Responsibility and Informed Choice
Producers and processors remain responsible for the food they provide as required by applicable law. Patrons are responsible for making informed decisions concerning food they voluntarily acquire. Nothing in this ordinance eliminates liability otherwise imposed by law for fraud, intentional misrepresentation, reckless conduct, or legally actionable injury.
8. Statutory Exceptions
This ordinance does not exempt any product or transaction from a requirement that controlling state or federal law expressly places outside municipal food-sovereignty authority. Meat and poultry subject to mandatory state or federal inspection requirements remain subject to those requirements to the extent required by law.
9. Municipal Liability
The Town does not inspect, approve, certify, warrant, or guarantee food merely because a transaction is governed by this ordinance. Adoption of this ordinance does not create municipal liability for the production, processing, preparation, sale, exchange, handling, storage, or consumption of local food.
10. Construction
This ordinance shall be liberally construed to accomplish its purposes and to exercise the full extent of municipal authority available under Maine law. Nothing in this ordinance authorizes conduct prohibited by controlling state or federal law or creates regulatory requirements beyond those expressly established by this ordinance.
11. Severability
If any provision or application of this ordinance is held invalid or unenforceable by a court of competent jurisdiction, the remaining provisions and applications shall remain in effect.
12. Effective Date
This ordinance shall take effect immediately upon adoption by the voters of the Town of Union.
