FOR IMMEDIATE RELEASE
CITIZEN LAUNCHES HIGH COURT CHALLENGE TO OVERTURN "SECRET" APPOINTMENT OF WESTERN CAPE POLICE COMMISSIONER
CAPE TOWN, 7 OCTOBER 2026 – A major constitutional showdown has arrived at the Western Cape High Court. Under Case No. 2026-24648, a private citizen and grieving father, Mr Vincent St. Laurant Phillips, has officially instituted a judicial review application to set aside the controversial appointment of the newly positioned SAPS Provincial Commissioner, Lieutenant General Sizakhele William Dyantyi.

The application targets the Minister of Police, the National Commissioner of the SAPS, Lieutenant General Dyantyi, and the Premier of the Western Cape. It challenges the legal framework, transparency, and constitutionality of the executive appointment process executed in late July 2026.
Pleading a "Dynastic" and Secret Succession

Mr Phillips, appearing in person, contends that the appointment of Lieutenant General Dyantyi to replace the retired Thembisile Patekile was shrouded in absolute secrecy, bypassed public advertisement, and skipped open competitive testing. The application argues that filling the top policing post in a province plagued by an unprecedented crisis of violent crime behind closed doors violates the constitutional principle of legality, rendering the appointment arbitrary and invalid.

Furthermore, the application challenges whether the mandatory provincial government consultation and concurrence required under Section 207(3) of the Constitution was an objective evaluation or a mere political rubber-stamping of cadre deployment.

Driven by Personal Tragedy and Public Interest
For Mr Phillips, the fight is deeply personal but brought in the wider interest of all working-class communities across the Cape Flats. In May 2002, his eldest son, Yannique Phillips, was brutally murdered. Twenty-four years later, like the vast majority of crime victims, his son's file remains an unresolved statistic.
"Ordinary citizens in areas like Belhar, Delft, Khayelitsha, and Hanover Park live under the daily horror of rampant gang violence and systemic police station failures where emergency calls go completely unanswered," says Mr Phillips. "We cannot allow the top seat of law enforcement to be decided through closed-door executive successions. The public has a right to an open, transparent, and competitive process to find a leader who can actually fulfill the objects of Section 205(3) of the Constitution to protect and secure the inhabitants of this province."

The Legal Road Ahead
In terms of Uniform Rule 53, the High Court action places an immediate obligation on the Minister of Police and the National Commissioner to dispatch the complete internal administrative record—including minutes of executive selection meetings, shortlists, and scoring sheets—to the court registrar within 15 days.
Mr Phillips has confirmed that formal notices have already been served electronically, yielding recorded read receipts from top parliamentary oversight officials and SAPS management. Physical service by the Sheriff of the High Court to Parliament and the Green Point Provincial Headquarters is currently underway.
