Many people assume that if your name is on the title deeds, the land is yours forever.
Not necessarily.
Under a legal principle known as adverse possession, someone who occupies land openly, continuously and without the owner's permission for a sufficient period of time may be able to acquire legal ownership of it.
Imagine a neighbour moves a fence a few feet onto your land. Years pass. The fence remains. The land is maintained as if it were theirs and nobody challenges it.

Our client owned the freehold of a mews property in Chelsea, London.
Without permission, the leaseholder of the first-floor flat had cut through the roof, installed a staircase and access structure, and created a rooftop garden.
When our client sought to recover possession of the roof space, the leaseholder claimed he had occupied it for more than 12 years and produced documents to support his case.
The claim appeared convincing.
However using specialist aerial imagery sourced through our surveying network, we obtained historic date-stamped photographs that told a very different story.
The imagery clearly showed that the roof access structure did not exist when the leaseholder claimed it did.
Sometimes the strongest evidence in a property dispute isn't on the ground. It's in the archive.

Q: Can I build a fence as high as I like on my boundary?
A: Not necessarily.
In most cases, planning permission is required for a fence, wall or gate over 1 metre high where it adjoins a road, footpath or pavement, and over 2 metres high elsewhere.
Before installing a new fence, it's also worth checking your title deeds. Many properties, particularly on open-plan developments, contain covenants restricting fence heights or prohibiting fences altogether in certain locations.
A quick check before you build could save a costly dispute later.

I once worked with a client involved in a lengthy and expensive boundary dispute.

For centuries in Japan, rooms were measured in something far more practical: floor mats.
Tatami mats, woven straw mats made to a strict 2:1 ratio, became the foundation of traditional Japanese architecture. Instead of designing a room first and fitting the flooring afterwards, architects designed the entire space around the mats themselves.
A room wasnโ€™t โ€œ12 square metres.โ€ It was โ€œ6 mats.โ€
The result was a system built around human experience rather than abstract numbers. If someone said a room was six mats, you immediately understood how many people could sit comfortably and how the room would function in daily life.

A four year neighbour dispute involving a ยฃ1.2m property in East Sussex has reached the High Court, centred on the position of a โ€œdog-proof fenceโ€ and the true legal boundary.
